1. Purpose
These terms govern the chauffeur-driven passenger transport services (transfers and hourly hire) booked on the site novaliafleet.com, by telephone or by message with NB TRANSPORT (“Novalia”), a SAS registered under SIREN number 101 349 009, with its registered office at 13 chemin des Espartes, 06800 Cagnes-sur-Mer. Every booking implies acceptance of them.
2. Services
Novalia offers: (i) transfers from one point to another, in particular to and from airports, train stations and ports; (ii) hourly chauffeur hire of a vehicle with chauffeur for a set period. Services are carried out by private hire chauffeurs holding the professional licence, employed by or partnered with Novalia, in vehicles insured for passenger transport.
Vehicle models are given as examples (“or similar”). Novalia may supply a vehicle of an equivalent or higher category at no extra charge.
3. Booking
Online booking is possible up to 3 hours before the pick-up time. The client is responsible for entering the addresses, the date, the time, the number of passengers and items of luggage and, where applicable, the flight or train number. The price is displayed before confirmation. The booking becomes firm on receipt of payment; a confirmation carrying a reference (NV-…) and a tracking link is then sent to the client.
A client who books for someone else guarantees that the passengers will comply with these terms.
4. Prices
Prices are in euros, all taxes included. They are set at the time of booking and include VAT, tolls, luggage within the vehicle’s capacity and the free waiting time: 60 minutes after actual landing for an airport pick-up, 15 minutes for a pick-up at any other address. Traffic conditions have no effect on the price. Child seats are an option charged in addition, €10 per seat and per ride, up to 2 seats per vehicle; the amount is shown before payment.
Any change requested by the client during the journey (an extra stop, a detour, waiting beyond the free time, extending an hourly hire) may give rise to a supplement, the amount of which is given to the client and accepted by them before it is applied.
5. Payment
The full price is payable when you book, by bank card or digital wallet, on the secure page of our payment provider Stripe. Novalia never has access to card details. A booking that is not paid within the time stated is not confirmed.
6. Changes and cancellation by the client
Any request for a change is sent to Novalia with the booking reference; it is accepted subject to availability and may lead to an adjustment of the price, which is given before confirmation.
Cancellation is free up to 24 hours before the pick-up time: the price paid is refunded in full to the payment method used. After that, or if the passenger does not appear at the meeting point beyond the free waiting time without telling us, the price remains payable.
Under article L. 221-2 of the French Code de la consommation, passenger transport services are not subject to the right of withdrawal that applies to distance contracts; the cancellation terms above apply.
7. Delayed or cancelled flights
Where the flight number has been given, the chauffeur adjusts the pick-up time to the actual landing time. If the flight is cancelled or diverted, the client informs Novalia as soon as possible: the booking is moved or cancelled free of charge where we are told before the chauffeur sets off.
8. The client’s obligations
- Be at the meeting point at the agreed time and reachable on the number given.
- Respect the capacity of the vehicle booked (passengers and luggage) and declare any bulky items.
- Tell us about any children travelling and the seats they need; wear a seat belt.
- Do not smoke or vape on board; treat the chauffeur and the vehicle with respect. Damage and serious soiling may be charged at the actual cost of putting the vehicle right.
The chauffeur may refuse to carry passengers where safety is compromised (capacity exceeded, dangerous behaviour).
9. Novalia’s obligations and liability
Novalia undertakes to carry out the service diligently, using licensed professionals. It cannot be held liable in the event of force majeure or an unforeseeable external event (exceptional weather, road closures, decisions by the authorities). Clients are advised to allow enough margin for their travel constraints, particularly on departures to an airport.
10. Lost property
Items found in a vehicle are kept and held for the client, who arranges to collect them; they can be sent on at the client’s expense.
11. Complaints and mediation
Complaints are sent to contact@novaliafleet.com, quoting the booking reference. Novalia endeavours to reply as quickly as it can.
Where a dispute is not resolved, a consumer client may refer it free of charge to a consumer mediator (médiateur de la consommation), whose details are given on request.
12. Personal data
The data collected when you book is processed in accordance with our privacy policy.
13. Governing law
These terms are governed by French law. Failing an amicable settlement, any dispute is brought before the courts having jurisdiction under the ordinary rules.
