1. Purpose and acceptance
These terms of use (“CGU”) govern access to the site novaliafleet.com and the use of its features: browsing the pages, the route search engine, requesting a quote, creating a client or business account, journey tracking and the application forms. They sit alongside the terms of sale, which govern the transport services themselves.
Browsing the site amounts to acceptance of these terms of use. They may be amended at any time; the version that applies is the one online when you connect. The date of the last update appears at the top of this page.
2. Publisher, host, contact
The site is published by NB TRANSPORT SAS (Novalia), whose full details appear in the legal notice. Any question about the site can be sent to contact@novaliafleet.com.
3. Access to the site
The site is available free of charge, 24 hours a day, except when interrupted for maintenance, updates or force majeure. Novalia works to keep the service running without being bound by an obligation of result, and cannot be held responsible for unavailability caused by the visitor’s network, their equipment or a third-party provider.
The cost of internet access and equipment remains the visitor’s responsibility.
4. Using the booking engine
The prices shown by the search engine are calculated for the route, the date and the vehicle class requested; they are cryptographically signed and valid for a limited time displayed on screen. After that, a new price is calculated.
The visitor undertakes to enter accurate information, in particular the pick-up and destination addresses, the number of passengers and items of luggage and, where applicable, the flight number. An incomplete address — a town with no street or number, for example — can prevent a firm price being set: the site then asks for the missing detail before going any further.
Online booking is made up to 3 hours before the pick-up. It is confirmed only after payment, on the terms set out in the terms of sale.
5. Client account and business area
Creating an account is optional in order to book. It gives access to your booking history, tracking, cancellation requests and invoicing documents.
- The visitor warrants that the information provided is accurate and keeps their email address up to date.
- Passwords are personal and confidential. Any action taken from an account is deemed to be that of the account holder; if you suspect fraudulent access, write to us immediately.
- Access to the journey history is opened only once the email address has been verified.
- A business account (travel agency, company, hotel, airline) is subject to approval by Novalia, which may ask for proof of trading.
- The account can be deleted at any time on request, with no effect on bookings already paid for or on accounting retention obligations.
Novalia may suspend or close an account in cases of fraudulent use, a clearly fictitious booking, non-payment or serious breach of these terms of use, having informed the account holder where that is possible.
6. Prohibited conduct
- Automatically harvesting, extracting or reproducing all or part of the site’s content (scraping, mirroring, copying the route or price database) for commercial purposes.
- Attempting to reach non-public areas, to bypass a technical limit, to interfere with how the site works or to test its security without written permission.
- Sending, through the forms, content that is unlawful, abusive, unsolicited advertising or that carries malicious code.
- Impersonating someone else, or booking in another person’s name without their agreement.
Automatic protective measures are in place (rate limiting, detection of automated submissions, honeypot fields); they keep no browsing data for advertising purposes.
7. Site content
Editorial information — distances, indicative journey times excluding traffic, meeting points, services, official taxi fares quoted for comparison — is given in good faith and sourced where that is relevant. It may change and has no contractual value: only the price displayed before payment and the booking confirmation bind Novalia.
Vehicle models are given as examples (“or similar”). The photographs illustrate the service and do not necessarily show the vehicle assigned.
8. Intellectual property
The Novalia brand, the logo, the visual identity, the text, the architecture of the site and the software are the property of NB TRANSPORT or used with permission. Any reproduction, display or adaptation, in whole or in part, without prior written consent is prohibited. The photograph credits appear on the photo credits page.
9. Links and third-party services
The site may carry links to third-party sites, over which Novalia has no control and for whose content it takes no responsibility. Some features rely on third-party services: mapping and address autocomplete (Google Maps Platform), online payment, and analytics with your consent. Their use is described in the privacy policy and on the cookies page.
10. Personal data and cookies
How personal data is processed is described in the privacy policy. The trackers that are set, and how to change your choices, are detailed on the cookies and trackers page. No analytics or advertising cookie is set without your consent.
11. Liability
Novalia takes reasonable steps to keep the information published accurate and the site secure. It cannot be held liable for indirect loss arising from use of the site, nor for an error or an outage caused by a third-party service or by the network.
12. Accessibility
The site is built to stay readable and usable with a keyboard, on a small screen as much as on a computer, with sufficient contrast and text alternatives to images. If you have trouble reaching a piece of information, write to us at contact@novaliafleet.com: we will send it to you another way.
13. Governing law
These terms of use are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action; failing that, the courts having jurisdiction under the ordinary rules will be seized.
